Quantum Blue Nursing is a solo telehealth psychiatric nurse practitioner practice owned and operated by Gretchen Genato, MSN, FNP-BC, PMHNP-BC, a licensed nurse practitioner in the State of California. Our principal business address is 444 West Ocean Blvd, Suite 800, Long Beach, CA 90802.

As a healthcare provider, we are a "covered entity" under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA). This means we are legally required to protect the privacy of your health information and to follow specific rules about how we use and share it.

If you schedule an appointment through ZocDoc or Headway, those platforms collect information directly and are governed by their own privacy policies. We receive appointment confirmation details but direct collection of payment and insurance information occurs on those platforms.

Mental health information has heightened protections. Under California law (Civil Code § 56.10 and Welfare & Institutions Code § 5328), mental health records and communications have additional confidentiality protections beyond standard HIPAA requirements. We take these obligations seriously and apply them to all patient information.

4. HIPAA & Protected Health Information

If you become a patient of Quantum Blue Nursing, your health information becomes Protected Health Information (PHI) under HIPAA. This includes clinical notes, diagnoses, treatment plans, prescriptions, and any communication related to your care.

Telehealth & HIPAA

All telehealth services are conducted through HIPAA-compliant, encrypted video platforms. We use platforms that have signed Business Associate Agreements (BAAs) as required by HIPAA, ensuring that all patient communications are encrypted in transit and at rest. Your telehealth sessions are private, secure, and not recorded without your explicit written consent.

Electronic Communications

Email and standard text messaging are not inherently secure and are not HIPAA-compliant. We use secure messaging systems for clinical communications. If you contact us through our website contact form or by email for general inquiries, please avoid including sensitive health information. For secure clinical communications, patients are directed to use our designated secure messaging platform provided during onboarding.

5. California Privacy Rights

California Confidentiality of Medical Information Act (CMIA)

California's CMIA (Cal. Health & Safety Code § 56 et seq.) provides protections for medical information that are in some cases stricter than federal HIPAA requirements. We comply fully with the CMIA. Under California law:

California AB 352 (Reproductive & Mental Health Data)

California AB 352 requires healthcare providers to implement additional access controls and disclosure restrictions for sensitive health data, including mental and behavioral health information. We apply these restrictions and do not disclose sensitive health data to out-of-state entities without your explicit written authorization.

Service Providers (Business Associates)

We use third-party service providers that may process personal information on our behalf. Any provider that handles PHI has signed a HIPAA Business Associate Agreement (BAA). Current service providers include:

AI-Assisted Documentation — Freed.AI

Quantum Blue Nursing uses Freed.AI, an AI-assisted clinical documentation tool, to support accurate and efficient clinical note-taking during and after appointments. Freed.AI operates under a signed HIPAA Business Associate Agreement and processes audio from telehealth sessions solely for the purpose of generating draft clinical notes.

Important safeguards:

You have the right to opt out of AI-assisted documentation. To opt out, send a written request to gretchen.genato@quantumbluenursing.com stating that you do not consent to the use of Freed.AI for your sessions. Your opt-out will be noted in your chart and honored at all future appointments. Opting out does not affect the quality of your care. You may change your preference at any time in writing.

As Required by Law

We may disclose information as required by applicable law, court order, subpoena, or government regulation, including mandatory reporting obligations required under California law (e.g., child or elder abuse reporting, Tarasoff duty-to-warn obligations).

If we believe you are in imminent danger to yourself or others, we may disclose information to emergency services or other appropriate parties as permitted or required by law and professional ethical obligations.
